These Terms and Conditions (“Terms”) govern your use of the Ruach Bakery website at ruachbakery.com and the purchase of products and services from Ruach Bakery (“we”, “our”, or “us”). By placing an order or inquiry with us, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. Ordering & Deposits
A non-refundable deposit of 50% of the total order value is required to confirm your booking. Your order date and slot will not be reserved until this deposit is received.
All orders begin with an inquiry submission through our website or direct communication. After reviewing your requirements and agreeing on scope, design, and pricing, we will issue a written quote. The following process applies:
- Submission of an order inquiry does not constitute a confirmed order.
- Upon acceptance of the quote, a 50% deposit invoice will be issued.
- The deposit must be paid within 48 hours of invoice issuance to secure your date.
- The remaining balance is due 7 days before the event date (or at collection/delivery, where agreed).
- Orders are not confirmed until the deposit payment is received and acknowledged by us in writing.
2. Cancellation Policy
Cancellations must be made at least 48 hours before the agreed collection or delivery date. The 50% deposit is non-refundable in all cancellation scenarios.
We understand that circumstances can change. Our cancellation terms are as follows:
- Cancellation more than 14 days before the event: deposit is forfeited; no further charges apply.
- Cancellation between 7–14 days before the event: deposit is forfeited; 25% of the remaining balance may be charged if materials have been sourced.
- Cancellation within 7 days of the event: deposit is forfeited; up to 75% of the total order value may be charged depending on production status.
- Cancellation within 48 hours or on the day: full order value is due.
- Rescheduling requests (subject to availability) may be accommodated without additional charge if made more than 14 days in advance.
In the unlikely event that Ruach Bakery must cancel your order (e.g. due to unforeseen circumstances or illness), we will provide a full refund of all amounts paid and endeavour to give you as much notice as possible.
3. Allergies & Dietary Requirements
It is the customer's responsibility to disclose all allergies, intolerances, and dietary requirements at the time of ordering.
Ruach Bakery products are prepared in a kitchen that handles nuts, gluten, dairy, eggs, soy, and other common allergens. While we take reasonable care, we cannot guarantee a completely allergen-free environment. Please note:
- All known allergens must be disclosed in writing before we confirm your order.
- We will do our best to accommodate dietary requirements (gluten-free, nut-free, vegan, etc.) where possible, but cannot guarantee a completely allergen-free product.
- It is the customer's responsibility to inform all guests of potential allergens.
- Ruach Bakery accepts no liability for allergic reactions that result from undisclosed allergies or intolerances.
4. Delivery & Collection
We offer both collection from our kitchen and delivery within our service area. The following terms apply:
- Collection is available by appointment only. Please do not arrive without a confirmed appointment time.
- Delivery is available within our service area. Delivery fees are quoted separately based on distance and order size.
- Delivery times are estimates. We are not liable for delays caused by traffic, weather, or other circumstances outside our control.
- Upon collection or delivery, please inspect your order immediately. Any concerns regarding damage or errors must be raised before leaving the premises or within 2 hours of delivery.
- Ruach Bakery is not responsible for damage to products after they have been accepted at the point of collection or delivery.
- Multi-tier cakes require careful handling; transportation instructions will be provided.
5. Payment Terms
We accept the following payment methods:
- Bank transfer (EFT) — details provided on invoice.
- Credit/debit card — processed securely through Stripe.
- Cash — for in-person collection only.
All prices are quoted in USD and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change; however, once a quote has been accepted and a deposit paid, the agreed price is locked in. Additional changes requested after confirmation may result in an amended quote.
6. Design, Colours & Customisation
We strive to deliver products that match agreed designs as closely as possible. However, please be aware that:
- Colours displayed on screens may differ slightly from the finished product due to variations in icing, food colouring, and lighting.
- Handmade decorations are unique; minor variations from reference images are expected and do not constitute a defect.
- Design changes requested after production has commenced may not be possible and may incur additional charges.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Ruach Bakery's total liability to you for any claim arising from or related to a product or service shall not exceed the amount you paid for that specific product or service. We are not liable for:
- Indirect, consequential, or incidental losses (including loss of enjoyment or event disruption).
- Losses arising from information you provided that was inaccurate or incomplete.
- Damage to products caused by improper handling, storage, or transportation after delivery/collection.
- Allergic reactions resulting from undisclosed dietary requirements.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, United States of America. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
9. Changes to These Terms
We reserve the right to update these Terms at any time. The most current version will always be available on this page with the date of last revision. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
